LA 135 Civil Litigation and Torts Course Objectives:

The student in LA135 will learn:

  1. How the legal system is organized and how it operates, which will include an overview of the following:
    • The reasons we have laws
    • The sources of laws
    • Classifications of laws
    • The civil litigation process, which shall include an overview of
      • The trial process, including but not limited to, jury selection, examining witnesses, closing statements, and verdicts
    • The dual court system and issues concerning jurisdiction;
    • The right to take an appeal from an unfavorable decision.
  2. The basic concepts of tort law, which shall include the following:
    • The study of strict liability
    • The study of intentional torts, which shall include the following
      • The study of intentional torts against the person, which shall include a study of battery, assault, false imprisonment, defamation, intentional infliction of emotional distress, invasion of privacy, and any and all defenses thereto
      • Intentional torts against property, which shall include a study of trespass to land, trespass to personal property, conversion, nuisance, and the defenses thereto; and
    • The basic concepts of negligence, which shall include a study of the elements of negligence as well as the defenses to negligence.
  3. How damages are determined and how they are awarded.
